A major conflict is brewing over whether the National Defense Authorization Act (NDAA) should block state-level AI regulations, and President Trump is pressuring Republicans to include a nationwide ban on state AI laws in the NDAA.
Trump argues that a single federal standard will be needed to avoid a “patchwork of 50 state regulatory regimes.”

A draft executive order being considered by Trump would result in states that impose “restrictive” AI regulations being penalized with limited broadband funding.
Republican lawmakers generally oppose repealing state laws, citing states' rights and federalism. More than 200 state legislators have called Congress will push back on AI preemption, arguing that states are better positioned to respond quickly to emerging technology issues.
“A blanket ban on the use of artificial intelligence at the state and local level, and regulation of automated decision-making systems, would abruptly end vibrant democratic debate in state legislatures and lead to a complete pause in policymaking at the very moment when communities are looking for immediate solutions,” they wrote.
Democrats have warned against giving big tech companies a “multi-year vacation” from government oversight.
They warned that the proposed federal preventative measure would prevent states from addressing emerging AI risks, putting children, workers, critical infrastructure and the environment at risk.
Even though the change was rejected 99-1, Trump has since been criticized for supporting big tech companies.
“Put it in the NDAA or pass it as a separate bill, and no one will ever be able to compete with America,” Trump concluded in the “Truth” post.
