Lawyer representing Mike Smithactor who plays Bubbles V Trailer park boys says the sexual assault charge against his client “will not be pursued in the media.”
“Well, what I'm saying is that this is an allegation at this point. It hasn't been proven. It's going to be tried in court, it's not going to be tried in the media,” defense lawyer Stan McDonald said in Halifax provincial court.
“In the meantime, we ask that you respect the privacy of everyone involved. That's all I have to say today. Thank you.”
McDonald spoke on Smith's behalf Monday.
Smith was charged with sexual assault in connection with an alleged incident that occurred on Dec. 30, 2017, according to court records. Court documents show Smith was charged by Halifax Regional Police on Oct. 2.
“It is actually quite common for allegations of sexual assault to arise years after the alleged incident,” said Crown attorney Nicole Ford, who confirmed to reporters that there is one female complainant in the case.

“It’s not uncommon, we see it regularly, and so there are no limits to sexual violence.”
News of Smith's indictment made international and entertainment media headlines, with coverage from TMZ, Variety, The Hollywood Reporter and the BBC.
“Every individual, regardless of their public status, public persona or anything else associated with their public character or profile, is not treated differently than any other person,” Ford said.
“We at PPS (Public Prosecution Service) take every case very seriously. We evaluate each case equally for each individual, maintain the integrity of the investigation separately and do not give anyone any special treatment based on their public profile.”
The case is being transferred to Dartmouth provincial court and Smith's next court date is set for Dec. 3.
The Crown was granted a gag order against the publication of any information that might identify the alleged victim.
Court documents show Smith was ordered not to communicate with or visit the alleged victim's place of work, home or school. The documents do not provide details of the charges.
This is not the first time Smith has been charged. In April 2016, Smith was charged with battery in Los Angeles for an incident at a Hollywood hotel involving a woman.
Misdemeanor domestic battery The charge was dropped a month later.
Trailer Park Boysa television series about a group of ex-convicts living in Nova Scotia and their misadventures, including petty crimes, first aired in 2001.
Trailer Park Boys announced in August that they had completed filming on the 10-episode 13th season, which coincides with the 25th anniversary of the series' launch.
In an emailed statement, Trailer Park Boys Incorporated said it is aware of the allegation and takes such matters seriously, and Smith has stepped down from his role as managing director.
“We understand how difficult an allegation of this nature is for everyone involved. Out of respect for the legal process, we will not comment further on this matter.”
