In this episode of The Misadventures of Governor Gasbag…
Illinois Governor J.B. Pritzker is a particularly arrogant man. Of course, he's far from the only bully in today's Democratic Party, but his simmering hatred of President Donald Trump, combined with delusions about the 2028 presidential race, appears to be inflating his ego beyond normal limits.
The perfect example occurred Thursday when Pritzer went on MSNBC's TDS-riddled “Briefing with Jen Psaki” to sympathize with former President Joe Biden's former White House press secretary over the alleged atrocities of ICE (Immigration and Customs Enforcement) agents continuing their now-dangerous job of apprehending illegal aliens whom Biden has almost welcomed to the country.
Psaki kicked off the holidayThus:
On Sunday you said you were considering prosecuting ICE agents who break the law. What can you tell us about this? What will it look like?
Great question—even though Pritzker undoubtedly knew it was coming, so he could have prepared what he thought was a compelling answer. This was not (emphasis mine):
We don't know if anyone will be prosecuted at the federal level. So we're looking at all the options at the local level with the state attorneys, with the attorneys general stalk people [ICE agents] when they break Illinois laws, when they break local laws.
Stop the tape.
To be clear, Federal Judge Sarah Ellis issued a temporary restraining order a week ago in response to a lawsuit by protesters and journalists who alleged excessive use of pepper balls and tear gas outside an ICE processing center in suburban Broadview, Illinois. In her ruling, Ellis expressed concerns about what she called the “indiscriminate” use of chemical agents and used her order to set limits on how federal officers could use them.
Besides, Illinois State Law Limits the use of tear gas and other chemical agents, especially with respect to their use by law enforcement against crowds, i.e., peaceful protests and constitutionally protected assemblies.
If you think back to the “peaceful protests” following the death of George Floyd in Minneapolis, you are not alone.
Moreover, does a confrontational mob doing everything possible to disrupt or prevent ICE agents from lawfully doing their job fall under the category of a “constitutionally protected assembly”?
“It appears they should be held accountable for violating local and state laws.” Illinois Gov. J.B. Pritzker talks with Jen Psaki about the possibility of prosecuting ICE agents who break the law. https://t.co/3o59Rx4qAL pic.twitter.com/fVM425g0Ma

By the way, Psaki was a predictable person.

So here's the thing – at least one of them:
According to State Democracy Research Initiativepublished by the University of Wisconsin Law School is no less than a conservative stronghold (emphasis added):
As state and local officials increasingly clash with federal officials over immigration enforcement, protest control and more, they may soon turn to a long-used state counter tactic: prosecuting federal agents or officials for violating state laws.
The bottom line is that states are legally allowed to prosecute federal officials for state crimes.within. Limitations stem from federal constitutional principle that states should not be able to undermine federal policy through targeted criminal prosecutiondoctrine known as Clause of Supremacy immunity.
But only this principle applies when federal officials are acting reasonably within the scope of their lawful federal duties. [Only] when federal officials act beyond the scope of your duties, violate federal law, or behave in an egregious or unreasonable manner, [can] government charges are moving forward.
Even where charges are ultimately dropped, states sometimes use prosecution as a form of opposition to controversial federal actions.
The real thing that's happening here, as well as with the Governor's (Gavin Newsom) hair gel in California, is exactly the last paragraph above.
Bottom line
While Democrats may face significant challenges in successfully prosecuting ICE agents, they remain relentless in their efforts to make immigration enforcement more difficult under the Trump administration.
Their approach is to create legal, policy, and operational obstacles to make it as difficult as possible for ICE to detain and deport illegal aliens, which includes filing lawsuits, imposing legal restrictions such as banning the use of tear gas against less-than-peaceful protesters, and highlighting allegations of federal abuses or violations.
In other words, exactly what Democrats have been doing since day one of Trump's second term.
