The legal action was filed after a local woman who said she voted for the Bloc said her special ballot was returned to her due to an address error on the envelope provided by Elections Canada.
Incumbent MP Sinclair-Desgagnier lost to Liberal Tatiana Auguste in one round in the April 28 election.
Sinclair-Degagnier's lawyer, Stephane Chatigny, argues that voter rights under the Charter were violated because her ballots were not counted and says a new election must be called soon.
Chatigny says other voters may have suffered the same error, as 16 more special ballots were not returned by the deadline.
