Today, the judge of the Federal Court of Appeal in California reproached the Trump administration in her zealous deportation policy and in the “Family collapse”. Judge Stephen Reinhardt from the Court of Appeal of the 9th District found that he had no authority to stop the expulsion of Andres Magan Ortis, but, nevertheless, took the time to write a brief conclusion in which he called his deportation “inhuman”.
“We cannot prevent the removal of Magan Ortis, but this contradicts the values of this country and its legal system,” Reinhardt wrote in a six -page letter. A coinciding opinion. “Indeed, the government’s decision to remove Magan Ortis belittles not only our country, but also our courts, which are allegedly called upon to achieve justice … I agree as a judge, but as a citizen – there is no.”
As Rainhardt explained in his opinion, Magan Ortis arrived in the United States from Mexico 28 years ago, built his family and career and paid taxes. His wife and three children are US citizens. His only legal violations were two drunk driving, the last of which occurred 14 years ago. “[E]Nevertheless, in March, the government decided to reject the request of Magan Ortis about the departure of the expulsion while he applied for a legal status of residence (the process that is still ongoing), and decided to deport it to Mexico.
Reinhardt especially drew attention to the fact that was repeatedly demonstrated in the first months of Donald Trump’s presidency, that the administration’s repressive measures regarding immigration were directed not only against cruel criminals. “President Trump said his immigration policy will be aimed at“ bad people, ”he wrote. “The government’s decision to send Magan Ortis shows that even“ good people ”are not safe. Magan Ortis, apparently, is the support of his community and a devoted father and husband. It is difficult to understand how the government’s decision to send him is consistent with the president’s promise with a“ big heart. ”I do not see such compassion in the decision of the government to deport Magan Ortis.”
