Thursday marks the 16th day of Sumer's closure. You'd think Democratic senators have larger concerns, such as the issue of Majority Leader John Thune (R-SD) propose to vote about extending Obamacare in exchange for a vote to reopen the government. Instead, Senate Democrats are outraged by a new video recorded by Department of Homeland Security (DHS) Secretary Kristi Noem that accuses them of causing a government shutdown. Several airports have already refused to broadcast the advertisement, considering it “coercive.” But forcing us to watch CNN live? Not forced at all.

So they plan to launch an investigation into Noem's posting of these videos at American airports on the grounds that it violates the Hatch Act. By saying “The Stolen Valor of a Senator,” Richard Blumenthal (D-CT) proves that these people are not serious; but the Americans I already know this.

Democratic senators argue that the Department of Homeland Security potentially violated the Hatch Act by asking airports across the country to play a video of DHS Secretary Kristi Noem blaming Democrats for the fallout from the government shutdown.
“This appears to be a flagrant violation of Section 715, which states: 'No portion of the funds appropriated in this or any other law may be used by any executive branch… for the preparation, distribution, or use of any… film presentation intended to support or defeat legislation pending before Congress, other than a presentation to Congress itself,” wrote the Democratic senator from Connecticut's Richard Blumenthal in a letter to DHS, quoting an excerpt from the article. The Hatch Act restricts certain political activities by federal employees and certain state, Washington, D.C., and local government employees who participate or work in federally funded programs. Penalties for violating it include dismissal from federal office, suspension without pay, demotion or party ban from federal office for up to five years, according to the Office of the Special Counsel.

The Hatch Act of 1939 was a federal law designed to restrict the political activities of government employees. Its primary purpose is to ensure that the federal workforce operates impartially, without political influence or coercion. The law aims to prevent the use of official power to influence election results and protect government officials from pressure to support specific candidates or parties. This structure helps support a system in which federal employment and promotion are based on merit rather than political affiliation.

Key words here: influence, coercion and election results. How does advertising that places blame where it rightfully belongs and outlines the consequences of that closure become formal influence or coercion? Which elections is Noem supposedly influencing? This is complete nonsense. The application of the Hatch Act has become a magic talisman that is thrown around whenever elected officials do something that someone doesn't like, regardless of whether that official is a Democrat or a Republican.
The Hatch Act also has few teeth, so one Congress after another has tried to deepen its enforcement mechanisms. So far these efforts have not been successful. However, as you may have guessed, the Democrats had clear violations of the Hatch Act. The Biden administration is the latest and best example.
Former Biden adviser Neera Tanden, one of the admitted auto-discovery handlers, reveals what constitutes a violation of the Hatch Act. it actually looks like this.
In a complaint filed Wednesday with the Merit Systems Defense Council, OSC alleges that Neera Tanden, director of the U.S. Domestic Policy Council, violated the Hatch Act by posting statements on social media soliciting donations to several different Democratic candidates for the 2024 general election, despite being warned against such postings.
“Congress has enacted a rule prohibiting all federal employees from raising funds for political candidates,” Special Counsel Hampton Dellinger said in a statement. “The Hatch Act provides no escape route for White House officials. “Back in May, I made it clear that my office would enforce the law as written.”
According to the complaint, Tanden repeatedly posted on social media urging people to donate to Vice President Kamala Harris and other Democratic candidates, even after the agency notified the White House last August that it violated the Hatch Act.
Another Biden Cabinet member, Health and Human Resources Secretary Xavier Becerra, spoke in his official capacity as health secretary and ended by praising Sen. Alex Padilla (D-Calif.) and calling for a vote for his nomination. re-election. Clearly a balanced political presentation.
At the gala, Becerra was presented with the 2022 American Dream Medallion Award and made remarks about HHS and the Biden administration's performance, which were reviewed and approved by an HHS ethics attorney. After a short video about Becerra was shown, naming him as the 25th secretary of HHS, Padilla presented him with the award.
“After the video ended, Secretary Becerra thanked Senator Padilla for the award and, deviating from prepared remarks, stated: “To my brother, my friend and senator, and the man I will be voting for in just over a month, Alex Padilla, thank you so much, Senator, for being there for all of us. We are proud to have you as our senator,” the report said. Some of Becerra's staffers attended the gala and recorded the remarks. “On the recording, one of his staffers can be heard choking up after the secretary's comments about Senator Padilla and saying, 'No, no, you can't say that.'
During the investigation, Becerra told OSC that his remarks were “impromptu” and reflected his “long-standing personal relationship” with Padilla. Regarding the voting portion of his statement, Becerra said, “I don’t think I thought of it as anything more than what I, as a responsible citizen, would be doing in the near future.”
OSC did not hesitate.
“Becerra’s proposed explanations do not mitigate the need to submit this report to the President,” the report said. The office also noted that Becerra has received “extensive information” about the Hatch Act since he took office.
There are also mild examples that seem to cross the line but are not outright violations. Like Congressman Eric Swalwell promoting and selling merchandise for the “No Kings” rally on October 18th.

Although California Governor Gavin Newsom is not a federal employee or official, he uses his office to push a progressive and Democratic agenda on steroids. Imagine what he would do if he ever became president. Kill this thought.

Meanwhile, Senate Democrats continue their fishing expeditions in search of a crime they can pin on the Trump administration. One would think that they had already learned, but that would be too similar to right.
The senators also asked DHS to provide information about the funding used to produce the video, including the cost, who approved the funds, whether anyone from the Trump administration was consulted about the video, and whether any outside contractors or organizations were involved in its creation, to assess whether any federal laws were violated or funds were misused, the letter said.
Expect this to go nowhere.
