Deconstructing the Narrative of the Resistance Judiciary – RedState

If you look like me, at any time you hear or see a news story that begins with: “X number of such and such experts” or “former intelligence officials” or “backward military officers” or some similar “signature”, speaking Y, ”you learned to reset off accounts. We must be impressed with the appeal to the authorities and/or the number of those who sign the proposal.





We are not. Even when they are judges.

Now it hurts me a little to say that, because I firmly believe in the judicial power and play an important role in our management. And, as the lawyer of the recovering, one who practiced legal courts in several courts in front of several judges for almost three decades, respect for the bench has taken root. I am well familiar with the fact that the decisions often do not go the way we want, but begin with the fact that the judges know what they are doing, and get it correctly than not. They receive this reverence for Solomon’s wisdom, which, I understand, is often unjustified. I just recognize my setting by default about this.

Therefore, when I saw story A few days ago, “42 retired judges” signed an “open letter”, criticizing the accusation of the Trump administration about the former FBI director James Komi, I received it. I knew that there was no need to put many reserves in it – that it was part of the Nevertrump varieties that could sound impressive; that I probably do not agree with their double; And that, in the whole scheme, it was not worth those ink or digital space used to create it. I wrote it.

But then, listening to my favorite podcast (“America this week“) On Saturday, the leading Matt Tybbi and Walter Kirn defeated him a little more, and I was stunned by the absolute absurdity of the parts of the letter that they shared.





So, I felt forced to look for him myself and see if it was as foolish as it sounded. Firstly, the word about the signed: the top of the list is Judge Michael Luttig, a former district judge of the US Court of Appeal in the Fourth District. His name may seem familiar, since he is a frequent speaking head on the outdated media that sound an alarm about a bad orange person and the like. Okay, it tracks.

I really did not recognize any of the other names in the list – not one of Missouri was from Missouri; It is amazing that few of them were from what we consider red states. However, there is a lot of California, Massachusetts and New York. Bearing in mind that all this is retired by judges and, therefore, will not have recent vintage, that the most charitable reading of political affiliation regarding judges and/or their appointed leaders consists of 75 percent democrats, 25 percent of the Republican Lean. And by charity, I mean that someone appointed by Ronald Reagan or George Bush is consistent with Donald Trump and the Republican Party in 2025. In other words, really, there may be two or three judges who still vote for the Republicans in this list.





This directly here undermines the “authority” that this message carries. Of course, we do not know which former judges contacted, who decided not to jump on this bandwagon, and whether they did it because of ideological motivation or because of a used embarrassment for those who did it.

Looks like I'm sharp? Well, let's move on to the body of the letter and analyze it (the main bullets are the language of the letter; subordinate comment):

  • “The rights and freedoms of the Americans are protected by the constitution and the rule of law.”
    • Check. We agree.
  • “These rights and freedoms of each American are in serious danger today, since President Donald Trump continues to corrupt by the authorities of his office, directing the Ministry of Justice of the United States and the Federal Bureau of Investigations in order to aim at his critics and his alleged political enemies for investigating and criminal judicial persecution.”
    • There is something to unpack there. This is largely their opinion/characteristic, but although I agree, it sounds ominously, I am interested in why they never spoke during the administrations of Biden or Obama. Yes, this is what is, but even if we take their characteristics for a clean coin, they deliberately turn a blind eye to everything that happened before January 20, 2025. It also suggests that a legal investigation or criminal prosecution.
  • “Each of his threat and every rising investigation and judicial persecution even more ruin the democracy and the rule of law of America’s right.”
    • Again, this suggests that there is nothing to investigate or pursue in court. And why are we always by default in America/our democracy with zero recognition that we are the republic?
  • “In the United States of America, the Constitution forbids President Trump to order an unreasonable judicial persecution of his alleged political opponents and his critics.”

  • “Although the Constitution does not prevent President Trump from dismissing federal prosecutors, not a single prosecutor should never be fired for refusing to make unreasonable accusations against political opponents and critics of President Trump.”
    • Well, again, they miss directly by the recognition that they are within the presidential sphere, and directly in the preliminary case against Komi and the declaration of accusations against him “unreasonable” and from his criticism of Trump (for example, criticism of Trump is a rarity).

I do not know who made this letter. I don’t know how close those who signed this, read it or how deeply they thought about it. And I am completely embarrassed by the once praised judicial system.
