A federal appeals court on Thursday upheld a lower court decision that bars the Trump administration from eliminating mental health grants that the Department of Education (ED) said “promote ideologies that are divisive based on race and gender.”
The administration said the grants will continue through the end of the year as expected, but will not be renewed next year. Judge nominated by Biden in October prohibited department from termination of grants. Now the 9th U.S. Circuit Court of Appeals has said the administration has failed to show it has a good chance of success and that a final decision will soon be made by the district court. according to to Holm.

The grants are intended to staff schools with more mental health professionals.
ED did not respond to Daily Caller News Foundation's request for comment.

Sixteen Democratic-led states sued administration over the cancellation in June, saying it prevented schools from offering services “critical to the well-being, safety and academic success of their students.” The states also argue that the repeal violates the ED General Education Act (GEPA), which requires applicants for federal grants are “addressing equity issues.”
The first Trump administration began issuing grants to fund mental health services in schools after the 2018 crisis. Parkland shootingHowever, in 2022, the program was taken over by the Biden administration to prioritize “programs that are inclusive and prepare school mental health providers to create culturally and linguistically inclusive and identity-safe environments” and “partner with historically black colleges and universities; tribal colleges and universities; and institutions serving minorities.”
While GEPA mentions eliminating “barriers based on sex, race, color, national origin, disability and age,” the Biden administration extended defining equality to include things like gender identity.
