Bondi vows appeal after Comey, James indictments dismissed by judge

US Attorney General Pam Bondi demanded legal action Monday against former FBI director James Comey and New York Attorney General Letitia James, speaking at an event in Memphis where she highlighted the work of the city's “Security Task Force.”

Bondi's comments came after U.S. District Judge Cameron Curry dismissed criminal charges against Comey and James and ruled that the prosecutor who brought the cases, Lindsey Halligan, was not lawfully appointed.

The judge agreed with Comey's defense, which argued that Halligan's appointment as interim U.S. Attorney for the Eastern District of Virginia was invalid, meaning the indictments were flawed.

“We will take all possible legal action, including an immediate appeal, to hold Letitia James and James Comey accountable for their illegal behavior,” he said. Bondi told reporters about this..

“I'm not concerned about someone who's been charged with a very serious crime,” she continued. “His alleged actions were a betrayal of the public trust,” Bondi added.

Comey was charged in September 2025 on charges of making false statements to Congress and obstructing a congressional investigation. This stemmed from his 2018 testimony about the origins of the FBI's investigation into Hurricane Crossfire.

This was an investigation into possible connections between Trump Campaign and Russia.

Comey has denied any wrongdoing, insisting his statements were “true to the best of my recollection” and calling the case a “political hit, not a pursuit of justice.”

Letitia James was charged separately. in October 2025 on mortgage and bank fraud charges, accused of misrepresenting the purchase of a Virginia home as a secondary residence in 2020 to secure better loan terms.

Prosecutors say she received nearly $19,000 over the life of the loan.

Comey and James' defense teams argued the prosecution was flawed, citing procedural irregularities and Halligan's controversial appointment.

Halligan, Trump's former legal aidewas the only federal prosecutor to sign Comey's indictment while acting as U.S. Attorney for the Eastern District of Virginia.

On Monday in Memphis, Bondi acknowledged Halligan, defending her credentials and role.

“We have appointed Lindsey Halligan as Special U.S. Attorney so that she can stand trial and fight in court the same way she has before, and we believe we will be successful on appeal,” Bondi said.

“And I will tell you, Lindsay Halligan, I have spoken to all of our lawyers in the US, most of them throughout the country, and Lindsay Halligan is an excellent lawyer in the US. And they are ashamed that they did not want her to be in power. Thank you,” she added.
