IsMy divorce from my second husband is getting nasty… because a custody battle has just broken out and they've both been blaming each other for it.
In new legal documents obtained by TMZ, Sia's ex-husband Daniel Bernard asks a judge for sole custody of their one-year-old child, Somersault Wonder Bernardclaiming she poses a “serious and immediate danger” to their son, but Sia says he has already been restricted from supervised visits due to a child pornography investigation.
In the papers, Daniel says: “Sia is an unsuitable and unreliable parent who struggles with substance abuse and addiction, leaving her unable to provide safe and stable care for Sammi. I am the only safe and reliable parent for our son. I am a doctor, young, healthy, I have no criminal history or problems with drug or alcohol addiction.”
Daniel wants Sia to undergo random and regular drug testing… and asks that she be limited to two-hour visits under professional supervision three times a week.
Sia responded that there was no urgent reason to give Dan full custody. She says Sammi has been and remains safe in her custody since their separation, noting that in August 2025 they had already agreed to give Dan very limited visits under professional supervision as he was under investigation by the LAPD and DCFS for “illegal child pornography” allegedly found on his computer's hard drive. She says she requested monitoring after she was informed of the investigation.
According to Daniel, Sia deliberately concealed the fact that she was hospitalized in Los Angeles for 2 weeks and tested positive for barbiturates and benzodiazepines without any legitimate medical explanation.
In addition to sole custody, Daniel is also asking for regular monthly child support of $77,245 per month.
Although Daniel was an oncologist when they first met, he claims he was unemployed and has no source of income because Sia “cut off all funding” for their joint venture, Modern Medicine. He says he is completely financially dependent on Sia, who has an “extremely successful and long-lasting music career.”
As for the child pornography investigation, Dan vehemently denies any involvement… and says he believes Sia “planted evidence” to limit her time with their child.
Sia says she understands the investigation was inconclusive and is now closed, but says that doesn't lessen her concerns about Sammi spending unsupervised time with him. However, she is open to additional time in Dan's custody if an experienced caregiver, such as Dan's mother or nanny, is nearby. However, she says she is not ready to take a drastic step away from the current custody agreement.
Regarding her sobriety, Sia says she has been sober for over 6 months and says she has agreed to drug testing for both her and Dan on multiple occasions, claiming that it was Dan who refused to undergo drug testing on a regular basis.
She says it's true she suffered from substance abuse 15 years ago, but recovery has been the “cornerstone” of her life.
She says, “Dan's attempt to weaponize my past journey to sobriety…serves no legitimate purpose and is intended only to distort the facts and undermine my credibility.”

Then Sia called the reason for the separation “irreconcilable differences” and asked for legal and physical custody of their child. Sia said she was open to visiting Daniel.
Daniel also fought with Sia over spousal support… a couple of weeks ago he asked the judge to order her to pay him more than $250,000 per month.
This is Sia's second divorce. She previously broke up with Eric Long back in 2016 after just over two years of marriage.
