In his tough-on-crime announcement on October 16, Prime Minister Mark Carney was asked what he would do if the Supreme Court (SC) overturned any of his tougher measures. His answer was: “Follow the law.” In other words, he does not believe in the supremacy of Parliament; that it is the elected deputies who determine the laws of the country.

Courts do not have the power to change the intentions or decisions of democratically elected parliamentarians. If the courts find that the law violates the Charter, the government must pass the amendments necessary to bring the law into compliance. It is not the government's place to throw up its hands by obeying such court decisions.

Carney further stated that he believes in the rule of law. Well, he's the chief legislator. This willingness to give in to the Supreme Court is more like the “supremacy of the judiciary.” I can find no section anywhere in our constitution that says judges make or make laws.

It appears Carney is already laying the groundwork for abandoning his supposed “tough on crime” agenda with the slightest resistance from the courts.
