The en banc 9th Circuit Court of Appeals voted Tuesday night to overturn the panel's decision allowing the National Guard to deploy to Portland and will rehear the case.

The panel in the case, consisting of two Trump judges and a Biden judge, also overturned the district court's blocking of the Guard deployment.
Tuesday's vote will not affect the situation in Portland because the Guard has not been deployed despite the commission's decision earlier this month. The Trump administration incomprehensibly never filed an appeal one of the district court's temporary restraining orders prohibiting the deployment of guards from any state.
